FREQUENTLY ASKED
Families often don't know where to begin. These are the most important questions — answered directly.
A sentence modification is a court motion that asks a judge to reduce or adjust an existing sentence. Indiana law (IC 35-38-1-17) allows defendants to petition for modification — especially if there have been changes in circumstances, evidence of rehabilitation, or completion of recommended treatment.
Eligibility depends on the offense, plea agreement, and prior modification attempts. Key factors: whether the original plea was open or closed, whether treatment programs have been completed, the inmate's conduct record, and whether the prosecutor will consent. Attorney Klain reviews every case before advising on realistic prospects.
Have a family member contact the office by phone or email. Attorney Klain does not make in-person initial visits and does not accept collect calls. To expedite evaluation, have ready: county of charge, inmate name and DOC number, all cause numbers, date of birth, out date, sentencing abstract, and any prior modification history.
Absolutely. Every Indiana county handles modifications differently. Prosecutors vary in their willingness to consent, and judges have distinct expectations for exit plans. Attorney Klain's county-specific knowledge across Hamilton, Boone, Hendricks, Johnson, and surrounding jurisdictions is a significant strategic advantage.
A successful petition includes: proof of completed recommended treatment, a facility progress report, a detailed exit plan covering housing, employment, and community ties, letters of support from clergy or employers, and a clear accounting of any write-ups with demonstrated remediation since. Attorney Klain will guide you through building the strongest possible package.
The firm offers flexible payment arrangements. Attorney Klain prefers to have fees arranged and substantially paid before any final hearing. Contact the office for a confidential conversation about your situation and fee structure.
